These Terms of Service ("Terms") govern your access to and use of the website located at jasonmatias.com (the "Site") and any products, services, and communications offered by Jason Matias, INC ("we," "us," "our," or "Jason Matias Fine Art"). By using the Site, placing an order, or opting in to our communications, you agree to these Terms. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site for lawful, personal, non-commercial purposes only. You agree not to use the Site in any way that could damage, disable, or impair it, or interfere with another party's use of it. We may modify, suspend, or discontinue any part of the Site at any time without notice.

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order or opt in to receive messages from us.

2. Intellectual Property

All artwork, photographs, images, designs, text, and other content on the Site are the property of Jason Matias Fine Art and are protected by copyright and other intellectual property laws. All rights are reserved.

Purchasing a print or artwork grants you ownership of the physical piece only. It does not transfer copyright, reproduction rights, or any license to reproduce, distribute, display commercially, or create derivative works from the image. You may not copy, download, reproduce, or use any image from the Site for any commercial or promotional purpose without prior written permission.

3. Artwork, Editions, and Authenticity

Our prints are sold as limited editions. We disclose edition details, including total edition size and the existence of any artist proofs, fully and transparently. Artist proofs are a small number of prints reserved outside the main edition and are identified as such.

Each edition is finite. Once an edition sells out, no further prints of that image at that size will be produced in that edition. Colors and appearance may vary slightly between your screen and the physical print due to monitor calibration, substrate, and the nature of fine art printing.

Where applicable, artworks are accompanied by documentation of authenticity and edition number.

4. Orders, Pricing, and Payment

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to refuse or cancel any order, including for suspected fraud, pricing errors, or unavailability.

Payment is due at the time of purchase unless otherwise agreed. We may offer financing options through third-party providers such as Affirm or Klarna. Those transactions are governed by the third party's own terms, and we are not responsible for their services or decisions.

Placing an order constitutes an offer to purchase. A confirmation does not guarantee acceptance until payment is processed and the order is confirmed by us.

5. Shipping, Delivery, and Installation

We ship artwork using methods appropriate to its size and value. Title and risk of loss pass to you upon delivery. Delivery timelines are estimates and not guaranteed.

For collectors in the Phoenix, Scottsdale, and Paradise Valley area, we may offer white-glove delivery and installation. The scope, timing, and any fees for these services will be agreed in advance.

You are responsible for providing accurate delivery information. We are not liable for delays or losses resulting from incorrect information provided by you, or from carrier delays outside our control.

6. Returns and Cancellations

Because each piece is a limited edition fine art print prepared for you, all sales are final. If a piece arrives damaged, contact us within 48 Hours of delivery with photographs and we will arrange a repair or replacement.

Commissioned or custom-sized work is non-refundable once production begins.

7. Text Messaging (SMS) Program

By providing your mobile phone number and opting in through our forms, you consent to receive text messages from Jason Matias Fine Art related to your art selections, inquiries, and consultations, which may include marketing messages. Consent is not a condition of any purchase.

Carriers are not liable for delayed or undelivered messages.

The Site may contain links to or integrations with third-party websites and services. We do not control and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.

10. Disclaimer of Warranties

The Site and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, Jason Matias Fine Art will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or any products or services. Our total liability for any claim arising from a purchase will not exceed the amount you paid for the product at issue.

12. Indemnification

You agree to indemnify and hold harmless Jason Matias Fine Art from any claims, damages, or expenses arising from your violation of these Terms or your misuse of the Site or any artwork.

13. Changes to These Terms

We may update these Terms at any time. Changes are effective when posted to this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in King County, Washington.
